Management and Administration of FIDIC 2017 Contracts

Introduction

This FIDIC contract training is designed to provide practical guidance for professionals involved in the project management or administration of projects requiring the FIDIC red book contract. This FIDIC training course covers essential management techniques and project management methodologies during the “Pre-Contract” phase, including the FIDIC Client Consultant Service Agreement, as well as the “Post-Contract” award phase, addressing all aspects of contract management and claims management. This hands-on course explains and demonstrates the application of FIDIC's conditions of contract for construction, known as the “Construction Contract”.

It includes a thorough review of the 1999 Contracts books, with highlights on the updates in the Second Edition. This FIDIC certification course will help participants gain the skills needed to effectively manage these documents, representing employers, consultants, or contractors.

Day 2:Document Structure and Legal Analysis

  • Development of conditions of contract and their legal implications.
  • How FIDIC conditions interact with various legal systems.
  • Risk assessment in contract management.
  • Choosing the right FIDIC contract form.
  • Detailed analysis of the 1999 contracts and Construction Contract.

Day 3;Managing Responsibilities and Roles

  • General provisions and issues across different clauses.
  • Detailed responsibilities of the employer, engineer, and contractor.

Day 4:Financial Management and Contract Execution

  • Understanding suspension and termination clauses.
  • Risk management, liability, and insurance under FIDIC conditions.
  • Addressing scenarios of force majeure and their contractual implications.


Day 5: Resolution of Claims and Disputes

  • Clause 20: Strategies for managing claims, disputes, and arbitration effectively.
  • Identifying and managing inherent project risks.
  • Detailed claims procedures for both contractors and employers.
  • Amicable settlement strategies and the role of Dispute Adjudication Boards.
  • Arbitration processes and best practices in dispute resolution.
